Supreme Court to Hear Texting Case

The Supreme Court has agreed to consider a case that may have wide-ranging implications. The case involves text messages sent by police officers in Ontario California. The officers’ conduct gave rise to an expectation of privacy that overrode the written policy, the court says. Even the issuance of a username and password may give rise to privacy unless the company makes clear such restrictions are solely intended to protect the employees personal information, not the employee, it says. It will be some time before the Supreme Court issues an opinion in this case.”]
