Ruling Suggests Limits on Employer’s Access to Personal E-Mail

New Jersey Supreme Court: Employee should have expectation of privacy in e-mail to lawyer. Marina Stengart had filed a legal suit against her former employer, Loving Care Agency, alleging discrimination. Loving Care’s lawyers argued she had been given no warning e-mails sent from a personal account would be monitored or stored. The trial court last year had rejected lower court’s arguments for privacy and confidentiality of the e mail she had sent. But the Supreme Court of New Jersey reversed that in its decision last week.”]
