Courts Grapple With Law Enforcement Use of GPS Tracking

Two recent court decisions highlight struggles that courts around the country are having over law enforcement’s use of GPS devices to track an individual’s movements. The New York Court of Appeals ruled in a split decision that state police must obtain a warrant before installing a GPS device on a person’s vehicle for tracking purposes. Wisconsin’s court of appeals last week ruled that the evidence gathered against him using a secretly installed GPS tracking device on his car did not constitute a violation of his Fourth Amendment rights against unreasonable search and seizure.”]
