Bartlett Morgan published an article on December 18, 2020, about Barbados and Jamaica being closer to operationalizing new privacy laws. Here’s a summary:
- The Government of Jamaica advertised several roles in the Office of the Information Commissioner after Barbados did the same exercise a few months ago. Both countries passed substantive data protection acts in the past 18 months but neither jurisdiction has taken the relevant procedural steps to make enforceable privacy laws.
- Jamaica requires the Minister with responsibility for data privacy to publish a notice in the Gazette while Barbados requires the Governor-General to proclaim the Data Protection Act, 2019.
- No compliance obligations will exist for parties processing personal information in these jurisdictions if the laws aren’t in force. Both jurisdictions need to see about the significant tasks of preparing regulations to guide compliance by controllers and processors of personal data.
