- Bermuda is a small island with 64,000 in population and home to some of the largest international companies worldwide.
- The local jurisdictional legislation has to keep pace with international standards to compete globally.
- There was raised awareness among local companies about the importance of meeting international standards because of the Proceeds of Crime Act in 2008, Anti-Terrorist Financing Act 2008, and International Sanctions Act 2003.
- The enactment of the European Union’s General Data Protection Regulation [“GDPR”] and Bermuda’s Personal Information Protection Act [“PIPA”] also added to the privacy regulatory regime.
- The Anti-Money Laundering and Anti-Terrorist Financing legislation had a positive effect of introducing individuals on the island to compliance and privacy issues. The finance and business community are on track for data privacy compliance as they have complied with AML/ATF and cyber policies.
- The risk of either privacy or cybersecurity disaster scenarios exposes private data and these unintended breaches could lead to more serious breaches, which could negatively impact businesses. Senior management and local company owners need to ensure their staff and colleagues embrace data privacy and security.
- Appointing a Privacy Champion, Ambassador or Data Privacy Officer [“DPO”] can initiate a compliance program. The DPO can re-iterate PIPA benefits such as the reduced risk of failure to meet data privacy & protection compliance and early identification of potential risks.
- Some steps Privacy Officers can take to create a culture of data privacy towards PIPA include providing training and awareness at all levels and discussing the repercussions and consequences of non-compliance.
