Data protection in Bermuda is currently a complex collection of sectoral regulations, regulatory guidelines and common law precedents established by the Bermuda courts. However, the aim of the Personal Information Protection Act 2016 (‘PIPA’) is to become the critical piece of legislation in Bermuda governing the right to the privacy of personal information.

However, the aim of the Personal Information Protection Act 2016 (‘PIPA’) is to become the critical piece of legislation in Bermuda governing the right to the privacy of personal information.
- Once the PIPA is entirely in force, it is expected that the data protection framework will be supplemented by an official body of determination and guidance. For the time being, the Office of the Information Commissioner has published a new body of jurisprudence.
- The appointment of Bermuda’s first Privacy Commissioner, Mr Alexander McD White, became effective on 20 January 2020. This appointment allowed the introduction of a new independent supervisory authority, the Office of the Privacy Commissioner for Bermuda. PIPA’s substantive provisions remain inoperative.
- The public health crisis brought by the COVID-19 (‘Coronavirus’) pandemic has shifted the local regulatory focus to legislative action. Through its regional public health partners and the World Health Organization, Bermuda remains diligent in tracking global developments.
- At its initial publication date, 25 June 2019, this guidance note continues to represent the privacy position in Bermuda.
