Appellate Court to Rule on FTC’s Case vs. LabMD

A panel of three federal appellate court judges heard oral arguments this week. The long-running data security dispute between cancer testing lab LabMD and FTC is now in the hands of the judges. The judges will make a ruling later this year in the case, which dates back to 2013. LabMD is requesting that the appellate court vacate the FTC’s final consent order, issued in July 2016, that requires, among other things, LabMD establish a comprehensive information security program; obtain independent, third-party assessments over the next 20 years.”]
